Replacement of the Operating Conditions and Special Certificates of Airworthiness – Limited Issued Under Exemptions Dated Before 2017
This Civil Aviation Safety Alert (CASA) is to inform owners and operators of aircraft with Special Certificates of Airworthiness – Limited (Special CofA – Limited) of the desirability of replacing the Operating Conditions associated with an existing Special CofA – Limited.
The existing “Exemption from Appendix F and Subsection 507.03(5) of Standard 507 — Flight Authority and Certificate of Noise Compliance and Subsection 507.03(a) of the Canadian Aviation Regulations” dated 2010 has been canceled.
It has been replaced by an exemption from subsection 507.06(2) and paragraph 507.06(3)(b) of the Canadian Aviation Regulations (CARs) which applies to the APPLICANT for a Special CofA – Limited.
This exemption cancels all preceding exemptions, but does not cancel existing Special CofA – Limited issued under them.
Earlier exemptions presented standards and conditions for issue, including guidance for the attachment of Operating Conditions to the Special CofA – Limited.
Those conditions for issue and Operating Conditions were both unclear and overly severe. In particular, Certificates are rendered invalid if the aircraft is modified or repaired, or the flight manual amended.
Because the new Operating Conditions are clearer and less stringent than those issued under previous exemptions, it is desirable from the perspectives of both the holder and Transport Canada Civil Aviation (TCCA) for the Operating conditions to be replaced.
All Operating Conditions attached to existing Special CofA - Limited should be replaced with all the Operating Conditions listed in the Appendix to the new Applicant Exemption.
Additional Operating Conditions specific to an aircraft may be added to those conditions if necessary.
Replacement of the Operating Conditions will require the replacement of the existing Special CofA – Limited, because the date of the Operating Conditions is called out on the Certificate.
Civil Aviation Safety Inspectors – Airworthiness (CASIs – Airworthiness) at local Transport Canada Centres will amend the Operating Conditions and issue the new Special CofA – Limited. There is no charge for amendment of the Operating Conditions or replacement of the Special CofA – Limited for those who currently hold a valid Special CofA - Limited.
Non-commercial operators are encouraged to request their new Operating Conditions and replacement of their Special CofA – Limited.
Commercial operators are encouraged to apply for a new Special CofA – Limited in order to meet the conditions of the new exemption and obtain their new Operating Conditions and Special CofA – Limited.
Owners and operators can contact a CASI - Airworthiness at the geographically appropriate Transport Canada Centre or Regional Office.
